We Protect the User's Privacy

This document applies to the collection and treatment of personal data of candidates (hereinafter "candidates" or "data subject"), collected through the website www.achievejoin.pt, describing the way in which they are treated, under the terms of the General Data Protection Regulation (EU) 2016/679 ("GDPR") and Law No. 58/2019 of 8 August.

Achieve Join's website www.achievejoin.pt is not intended for use by minors.

Achieve Join, Lda., registered at the commercial registry office in Lisbon, NIPC 510039715, headquartered at Rua Fernando Vicente Mendes, 4 B, 1600-880 Lisboa, is the responsible for processing the candidates’ personal data, determined the purposes and means of treatment.

We collect and process your personal data directly from you.

1. How we use Personal Data

Whenever Achieve Join processes personal data, it does so for specific purposes and based on a legal basis for such process.

The personal data that it collects includes the name, e-mail, curriculum vitae, telephone number, among others provided by the candidate. The purpose of collecting them is to manage contacts with candidates, recruit and select and assess the candidate's profile in terms of available job opportunities, based on the consent of the data subject.

In case you do not provide your personal data, Achieve Join will be unable to assess the adequacy of your profile to existing job opportunities. In this context, Achieve Join does not collect or process special categories of data, therefore it requests that the candidate does not provide such data.

2. To whom we communicate Personal Data

Achieve Join may communicate your personal data to client companies (potential employers), as part of the recruitment process.

Within the scope of its activity, Achieve Join may resort to third-party service providers (eg security companies, IT service providers, etc.), which will process the data exclusively on behalf of and in accordance with Achieve Join's instructions.

Achieve Join may share some of your personal data with third parties to the extent required by law (for example, for communication with judicial authorities).

3. Transfers of Data to Third Countries

Achieve Join does not transfer your personal data to a location outside the European Economic Area (EEA).

4. How long do we keep Personal Data

Personal data will be kept by Achieve Join for the applicable legal periods and, in its absence, for the period necessary to fulfill the purposes for which they are intended. As a rule, the personal data of the candidates will be kept for a period of two years, unless consent is revoked by the data subject at a previous time.

The data will only be kept for a longer period if the candidate is placed or when the treatment is necessary to comply with legal obligations to which Achieve Join is subject or for the purposes of declaration, exercise or defense of a right in a judicial process.

5. Security of Personal Data

Achieve Join adopts the appropriate technical and organizational measures to protect personal data against accidental or unlawful loss, destruction or damage, as well as to ensure that the data provided is protected against access or use by unauthorized third parties.

6. Your rights regarding Personal Data

  • The right to access your personal data and to correct it
    Achieve Join ensures that all Personal Data is correct. The data subject has the right, but also the responsibility, to ensure that changes to their personal data are communicated to Achieve Join so that it can guarantee the permanent update of the data.
    The data subject can also access his personal data, as well as obtain the following information: (a) purposes for which his personal data are treated; (b) type of personal data that is processed; (c) entities to whom the personal data may be communicated, including entities located in countries outside the European Union or international organizations, in which case the data subject will be informed of the guarantees applied to the transfer of his data and the means of obtaining a copy of them, or where were made available; (d) period of retention of his data or, if this is not possible, the criteria for setting that period; (e) rights he have in the processing of his personal data; (f) if personal data has not been collected from you, information about its origin and the type of data in question; and (g) existence of automated individual decisions, including profiling, and, in this case, information about the underlying logic of such processing, as well as the importance and expected consequences for you of that data processing.
  • The right to erase
    OThe data subject has the right to obtain the erasure of his personal data, without undue delay, when one of the following reasons applies:
    • personal data is no longer necessary for the purpose that led to collection or processing of it;
    • the data subject withdraws the consent on which the data processing is based, if there is no other legal basis for the referred processing;
    • the personal data was processed unlawfully;
    • personal data must be erased to comply with a legal obligation to which Achieve Join is subject.
  • Data portability
    In cases where Achieve Join invokes the candidate's consent as a legal basis for processing or the fact that the processing is necessary for the fulfillment of a contract, and in which personal data are processed automatically, the candidate has the right to receive the personal data that he has provided to Achieve Join in a structured, commonly used and machine-readable format, and to require Achieve Join to transmit them to another when this is technically feasible.
  • Right to limit processing
    The candidate has the right to limit the processing of his personal data by Achieve Join in case of:
    • the candidate contests the accuracy of the personal data, until Achieve Join has taken sufficient steps to correct them or to verify their accuracy;
    • the processing is unlawful, but the data subject does not want Achieve Join to erase the data;
    • Achieve Join no longer needs personal data for processing purposes, but such data is required by the holder for the purposes of declaration, exercise or defense of a right in a judicial process; or
    • the candidate has objected to the treatment for reasons of legitimate interest, until it is verified that Achieve Join has compelling legitimate reasons to continue the treatment.
    In cases where personal data are subject to these limitations, Achieve Join will only process them with the candidate's consent or for the purposes of declaring, exercising or defending a right in a legal proceeding.
  • Right of opposition
    The data subject has the right to object to the processing of his personal data at any time, for reasons related to his particular situation, in the following situations:
    • When data processing is based on Achieve Join's legitimate interest;
    • When data is processed for purposes other than those for which they were collected, but which are compatible with them.
    • Data processing for direct marketing purposes, including profiling.
    In these cases, Achieve Join will stop processing personal data, unless it has legitimate reasons to carry out such treatment and these prevail over the interests of the respective holders.
  • Right not to be subject to exclusively automated individual decisions
    Achieve Join will not make decisions that affect the holder of personal data based on exclusively automated processes and decisions.
  • Right to withdraw consent
    In cases where Achieve Join invokes consent as a legal basis for processing, the data subject has the right to withdraw consent at any time.
    Withdrawal of consent does not affect the lawfulness of processing previously carried out based on consent. In case of withdrawal of consent, personal data will no longer be processed, unless there is another reason, the need to comply with legal and regulatory obligations or the legitimate interest of Achieve Join, which justifies such treatment.
  • Right to file complaints
    The data subject is also entitled to file a complaint with the National Data Protection Commission (www.cnpd.pt), if he considers that the processing of his personal data violates the applicable legislation.

The exercise by the holder of the personal data of the rights indicated above is free of charge, unless the request is manifestly unfounded or excessive, in which case a reasonable fee may be charged considering the associated costs.

8. Changes to this Privacy Policy

Achieve Join may change or update this document at any time, informing the holders of these changes or updates, by communicating the updated Privacy Policy to candidates.
